This appeal has been filed by the State/appellant with a prayer to grant leave to appeal against the impugned judgment and order of dated 17.05.2001 passed by Special Judge (Gangster Act), Meerut whereby the respondent/ accused Tanveer was acquitted in Case No. 89/1994 (State Vs. Tanveer) for the offence punishable under Section 2/3 of Uttar Pradesh Gangsters and Anti-Social Activities (Prevention) Act, 1986, P.S. Kotwali, District Meerut.
Learned trial has acquitted the respondent Tanveer for the offence punishable under Section 2/3 of Uttar Pradesh Gangsters and Anti- Social Activities (Prevention) Act, 1986 on the ground that he has been acquitted in the cases on the basis of which gangster act was imposed on him.
Accordingly, I find no infirmity in the impugned order passed by the trial court.
In view of above, this application seeking leave to appeal is, accordingly rejected and consequently the appeal is also dismissed.
