Heard Sri Ratan Singh, learned AGA on the leave application.
This leave application is filed for grant of leave for filing the appeal against the order dated 21.02.2007 passed by Special Additional Sessions Judge, Court No. 1, Bulandshahar, in Sessions Trial No/Special Case No.1/1995 (State Vs. Roop Ram), vide this impugned judgement Courts below has acquitted Roop Ram from the charge under Section 7/13 of Prevention of Corruption Act, 1988.
The facts of the case are that the complainant lodged the FIR against the respondent who was the constable in the P.A.C. The complainant lodged the FIR that the respondent has taken 23300 rupees from him for the appointment of his son in P.A.C.
Perusal of the record shows that there are so many contentions in the evidence produced by the prosecution and the FIR is lodged after four months of occurrence and furthermore the respondent was not the appointing authority in the P.A.C. Department.
On the basis of above discussion I come to this conclusion that there is no illegality or perversity in the impugned order. It cannot be said that the view taken by the Court below is not a possible or plausible view and no indulgence is required. Hence, the application for leave is rejected.
Consequently, the appeal is rejected.
