Heard, Sri Amit Sinha, learned AGA on the leave application.
This application is moved for the grant of permission to file the appeal against the judgement and order dated 08.03.2007 passed in Sessions Trial No. 185 of 2005 by the Additional Sessions Judge/FTC, Court No. 3, by the impugned judgement Court below has acquitted the respondents Ramesh Yadav and Munni Devi from the charge under Sections 498-A and 306 IPC. Evidence adduced by the prosecution reveals that the information regarding the instance was given by the respondent Ramesh Yadav (husband) to the parents of the deceased. There were delay in the lodging of FIR and the FIR is lodged due to the political rivalry in the village. There is single ligature mark found on the neck of the deceased. Deceased was in the depression and tension for being issue less even after the eight years of marriage.
It cannot be said that the view taken by the Court below is not a possible or plausible view. There is no illegality or irregularity in the impugned judgement and no indulgence is required. Hence, the application for leave is rejected.
Consequently, the appeal is rejected.
