Heard learned counsel the applicant-State of U.P. and Sri Padmaker Pandey, learned counsel appearing for O.P.No.2- Ram Bilas Agarwal.
Learned counsel for O.P.No.2, Sri Padmaker Pandey, has produced two orders of Hon'ble Supreme Court passed in Special Leave to Appeal (Crl.)No.5667 of 2016 dated 3.11.2017 and 23.3.2018.
Vide order dated 3.11.2017, it is clear that a demand draft for a total sum of Rs.55 Lakhs was handed over to learned counsel for respondent-State of U.P. The Court had further observed that the petitioner had given an undertaking to deposit a further sum of Rs.60 Lakhs within a period of two months from the date of order.
In the order dated 23.3.2018, the Hon'ble Supreme Court had observed that the petitioner's father has brought a demand draft for an amount of Rs.45,00,000 ( Rupees Forty Five Lakhs) and remaining amount of Rs.15,00,000( Rupees fifteen Lakhs), he has given an undertaking to pay on the next date. The matter is listed on 7th August, 2018 before Hon'ble Supreme Court.
Considering this aspect of the matter, this bail cancellation application moved by the State of U.P. against Ram Bilas Agarwal, who is father of Praveen Agarwal is rejected with further observation that the Opposite Party No.2 shall comply with the order of Hon'ble Supreme Court passed on 23.3.2018.
With these observations, the bail cancellation application is being disposed of.
