Heard Sri Ratan Singh, learned A.G.A. on the point of admission of the appeal against the judgment and order dated 4.4.2009 passed by Additional Sessions Judge/Fast Track Court No. 3, Gorakhpur in Session Trial No. 258 of 2006. By this impugned judgment the trial court held the accused respondent guilty under Section 323, 325, 4504 and 380 IPC but in place of sentencing them immediately court released the accused-respondent Ram Balak Singh, Sahab Sinch and Vashisth Singh on the probation of two years under Section 4 of the Fist Offender Act. They will file the bond for keeping good conduct and any of the violates this condition, then the court will summon them to sentence imprisonment.

Hence the appeal is dismissed at the stage of admission.
