1. Heard learned Standing Counsel for appellants and Sri Vivek Kumar Singh, Advocate for respondents-landowner.
2. This appeal under Section 54 of Land Acquisition Act, 1894 has arisen from judgment and award dated 05.03.2003 passed by Sri P.N. Rai, District Judge, Meerut in Land Acquisition Reference (hereinafter referred to as “LAR”) No. 41 of 2001 awarding compensation at the rate of Rs. 300/- per square meter, besides other dues as payable under the statute.
3. Reference Court vide award in question has decided 17 LARs collectively. Against one LAR, i.e., LAR No. 39 of 2001 (Kunwar Pal Singh Vs. State of U.P. and others) State of U.P. came up in First Appeal No. 986 of 2004 (State of U.P. and another vs. Kunwar Pal Singh) and the same has been dismissed by detailed judgment of this Court passed on 30.05.2017.
4. Learned counsel for parties, at the outset, admitted that issue raised in present appeal is squarely covered by aforesaid judgment since against same judgment and award passed by District Judge, Meerut aforesaid judgment dated 30.05.2017 has been passed.
5. Hence, for the reasons stated in this Court's judgment dated 30.05.2017 passed in First Appeal No. 986 of 2004 (supra), this appeal is dismissed.
