Court No. - 11
Case :- GOVERNMENT APPEAL No. - 4471 of 2007 Appellant :- State Of U.P.
Respondent :- Nayabuddin And Others Counsel for Appellant :- Govt.Advocate,Rajiv Asthana
Hon'ble Ifaqat Ali Khan,J.
Heard Sri Ratan Singh, learned AGA, on the leave application.
This leave application is moved for the grant of leave to file the appeal against the judgement and order dated 02.02.2007 passed by Additional Sessions Judge, Court No. 17, Kanpur Nagar in Sessions Trial No. 684 of 2005 (State Vs Nayabuddin and others).
The facts of the case are that the marriage of Arjuman Rais daughter of complainant was settled with respondent No. 1 (Nayabuddin) but before the marriage, Arjuman Rais said to Nayabuddin that he has to give two lacs rupees to her father otherwise she may not marry him. On it Nayabuddin spoke loudly in the neighbouring house of the complainant said that if she will not marry me, I will not let her married with any person. In this tension Arjuman Rais committed suicide.
There is no evidence of abatement by the accused persons to Arjuman Rais for committing the suicide. There is no illegality or perversity in the impugned judgement. It cannot be said that the view taken by the lower court is not a possible or plausible view. Hence, the application for leave is rejected.
Consequently, the appeal is rejected.
