JUDGMENT / ORDER

Ref:- Civil Misc. Delay Condonation Application No.1 of 2018 Having heard Sri A.K. Ray, learned counsel for the appellants and Sri Rajesh Kumar Sharma for the respondent no.1.
We find that sufficient cause has been shown on behalf of the State for filing this appeal which is reported to be beyond time by 192 days.
The cause shown is sufficient to condone the delay. We accordingly allow the delay condonation application. The appeal shall be treated to be within time and the office shall give a regular number to the same.

Heard Sri A.K. Ray, learned counsel for the appellants and Sri Rajesh Kumar Sharma for the respondent no. 1.
The appeal has been filed by the State of U.P. questioning the correctness of the judgment of the learned Single Judge dated 07th Feb, 2018 whereby the petition filed by the respondent has been allowed, and the order passed by the District Basic Education Officer dated 29th November, 2000, the order dated 29th September, 2000 as well as the order dated 31st March, 2000 has been set aside on the ground that the orders had been passed in violation of principles of natural justice and even otherwise the intervening judicial orders have also been taken notice of.
In our considered opinion and having considered the submissions raised, we find no illegality in the approach of the learned Single Judge in allowing the writ petition on the findings recorded in the impugned judgment.
The appeal lacks merit and is accordingly rejected.
