(Order on Crl. Misc. Delay Condonation Application No. Nil of 2008:) Heard learned A.G.A. and the counsel for the accused respondents.
The instant time barred (beyond 8 days) appeal was filed in 2008, the delay condonation application was not supported by an affidavit. The affidavit in support of the application was filed only on 28 May 2016. The Court finds no satisfaction why the affidavit was filed after such a long lapse of time. It appears that the State is not interested in pursuing this appeal in earnest necessity. Consequently, the Court is not inclined to condone the delay.
The delay condonation application is rejected for unexplained laches.
(Order on Appeal) The Delay Condonation Application having been rejected, this appeal stands dismissed on the ground of laches.
