Learned counsel for the appellants states that special appeal involving similar dispute has already been dismissed by the coordinate Bench of this Court vide its judgment dated 24.11.2020 (State of U.P. and 2 Ors. vs. Nem Singh).
In view of the above, and as the controversy involved in present matter is squarely covered by the judgment of Prem Singh Vs. State of Uttar Pradesh and others 2019(10) SCC 516, we dismiss the appeal in order to be governed by the judgment dated 24.11.2020 passed in Special Appeal Defective No.997 of 2020.
