This appeal has been filed by the State/appellant with a prayer to grant leave to appeal against the judgment and order dated 25.2.2009 passed by Additional Sessions Judge-V, Agra whereby the accused/respondents Jairaj, Jaswant, Heero @ Heera Singh and Hari Babu were acquitted for the offence punishable under Sections 306/201 IPC, Police Station Achhnera, District Agra.
As per prosecution version, Smt. Sarvesh sister of informant Shashi Kumar was married with Laxman Singh before 10 years of incidence. Accused/respondents Jairaj, Jaswant, Heero @ Heera Singh and Hari Babu who are the family members of Laxman Singh husband of deceased were harassing Smt. Sarvesh due to which she committed suicide on 15.1.2007. PW-1 informant Shashi Kumar admitted before trial court that her sister Smt. Sarvesh was living with her husband Laxman separately from the accused persons. Accordingly, learned trial court acquitted the accused- respondents.
Perused the impugned judgement. I find no infirmity or illegality in the impugned judgement and order as the view taken by the learned trial court is a possible view based on reasoning.
In view of above, this application seeking leave to appeal is, accordingly rejected and, consequently the appeal is also dismissed.
