This special appeal has been filed by the State of U. P. through Secretary, Education, Government of U. P. Lucknow against the judgement and order dated 12.10.1998 passed by learned Single Judge in Civil Misc. Writ Petition No. 32526 of 1998; Shri Harish Chandra Tiwari Vs. State of U. P. and others, which runs as under:
"The facts of the case are covered by the judgement of this Court in writ petition no. 3754 of 1990 Shital Prasad Tripathi Vs. State of U. P. & others decided on 22.8.90, writ petition no. 42417 of 1997 R.M. Pullan Vs. State of U. P. & others decided on 16.12.97 and W.P. No. 42986 of 1992 Mahesh Pratap Narain Awasthi & others Vs. State of U. P. & others decided on 1.9.1995. Following the said decisions this petition is also disposed of and the respondents are directed to include the petitioner's service in private institution in D.A.V. Inter College, Mahoba for calculating pension and other retirement benefits."
Learned Standing Counsel advancing argument at great length has failed to demonstrate that the facts of this case are not covered by the facts of the judgement referred to in the impugned order.
Thus, this special appeal lacks merit and is accordingly dismissed.
