(Order on Crl. Misc. Delay Condonation Application No. Nil of 2007:) Heard learned A.G.A. and the counsel for the accused respondents.
As the order sheet reflects that the State was granted time by this Court on 21 February 2014 and again on 27 March 2014 to file an affidavit in support of the delay condonation application filed under Section 5 of the Indian Limitation Act. Despite several opportunities having been given, the State has not filed the same. It appears that the State is not interested in pursuing this appeal in earnest necessity.
Consequently, the delay condonation application is rejected for unexplained laches.
(Order on Appeal) In view of the delay condonation application having been rejected, the instant appeal is dismissed.
