Heard Sri Ratan Singh, learned AGA and perused the record.
This leave application is moved for the grant of leave to file the appeal against the judgement and order dated 24.02.2007 passed by Special Judge (D.A.A.) Hamirpur in Special Case No. 72 of 2001. This case is of extortion. Perusal of the record shows that allegation of extortion was the main allegation of extortion against the Rajesh Khanna who was expired before the Trial started in the lower Court and there was no evidence against the respondent Nos. 2 and 3, therefore, respondent Nos. 1, 2 and 3 may have acquitted from the charge under Section 378, 323, 504, 506 (2) IPC.
Perusal of the record shows that there is no evidence against the respondents and there is no illegality or perversity in the impugned judgement. No indulgence is required. Hence, the application for leave is rejected.
Consequently, the appeal is rejected.
