Counsel for the State, invited our attention to the judgment of a Division Bench of this Court dated 27.10.2017, disposing of a bunch of special appeals filed by the State, and submits that the questions raised in the instant appeal are squarely covered by the said judgment and, hence, the instant appeal also deserves to be allowed in terms thereof. Counsel for the respondents does not dispute the submissions made on behalf of the State. In view thereof, we allow the special appeal in terms of judgment dated 27.10.2017 passed in a bunch of special appeals, bearing Special Appeal No. 57 of 2006 and connected appeals. Consequently, writ petition filed by the respondents is dismissed.
