The State has preferred this Appeal for a period of 26 years some of the respondents have remained un-served. Sri H.H. Khan, has appeared for some of the respondents but no Vakalatnama is there on record.
May that as it may be the appeal challenges the award in MACP No.28 of 1988 decided on 22.2.1993.
Facts are not necessary as the amount of Rs.28500/- has already been deposited. Injured was a guarder and he has been compensated for the injures. There was also a death of Sita Ram in the said accident in which his also the award was passed but it is not made subject to appeal.
On smallness of amount and on passage of time, this appeal is dismissed. The interim relief shall stands vacated. The amount awarded be disbursed to the claimants.
