Writ petition has been filed for quashing the F.I.R. Dated 25.10.2018 registered as case crime no. 3206 of 2018 under Sections 363,366 I.P.C., Police Station -Shahibabad, District Ghaziabad.
A perusal of the F.I.R. indicates that in substance, allegation has been made that the daughter of the informant Sabia alias Soni was enticed by Wasim and Bhura and two unknown boys. The petitioner is the mother of Wasim.
Counsel for the petitioner submits that the petitioner has been wrongly impleaded in the present case on the basis of Wasim, who is not traceable and the police is harassing the petitioner.
In view of the facts of present case, writ petition is disposed of finally with the direction that the petitioner shall not be arrested in case crime no. 3206 of 2018 under Sections 363,366 I.P.C., Police Station -Shahibabad, District Ghaziabad till submission of police report under Section 173(2) Cr.P.C.
The petitioner shall cooperate in the investigation.
