Petitioner claims to have retired from the post of Village Development Officer on 31.1.2019. It is alleged that though all formalities have been completed on part of the petitioner but none of his retiral benefits due and payable has been released so far. In respect of such grievance petitioner has approached the authorities concerned, but no decision has yet been taken and hence, petitioner is before this Court.
Learned Standing Counsel submits that petitioner's grievance shall be examined by the authority competent, in accordance with law, at the first instance.
Law is settled that having worked for sufficient length of service it becomes right of the government servant concerned to receive retiral benefits in accordance with the applicable provisions of law. Once the petitioner has retired in month of January, 2019, it was expected that authorities would consider petitioner's claim for release of retiral benefits, but it does not appear to have been done so far.
In the aforesaid facts and circumstances, this writ petition stands disposed of permitting the petitioner to approach respondent no.4 by making a representation in respect of his grievance, noticed above, alongwith certified copy of this order, annexing all materials in support of his claim, within a period of two weeks from today. In case such a claim is raised, the authority concerned shall ensure that all retiral benefits which are due and payable to petitioner are released to him, within a further period of three months thereafter. A specific order in that regard would also be passed by the authority concerned within the aforesaid period.
