This appeal has been filed beyond limitation by 2 years 275 days. It was presented on 29.11.2005.
Perusal of the affidavit accompanying the delay condonation application shows that explanation offered is wholly unsatisfactory. The sanction to file appeal was accorded by the competent authority on 13.01.2003. The State Government has also informed that permission to file first appeal has been granted on 29.04.2003. Thus, the delay caused for filing the appeal shows negligence on the part of the appellants. Therefore, the delay cannot be condoned and the delay condonation application deserves to be rejected.
Apart from above, it is relevant to note that by Notification under Section 4(1) of the Land Acquisition Act,1894, dated 23.08.1986, certain lands of claimants- respondents were acquired in the village Devrala, Pargana and Tehsil Khurja, District Bulandshahar.
The valuation of the appeal is Rs.56,052.50, which is much below the monetary limit fixed by the State Government for filing and contesting first appeals arising from land acquisition matters. An order dated 17.10.2016, in First Appeal No. - 29 of 2014 {Agra Development Authority Vs. Munna Lal (Deceased) and 7 Ors.} was passed with reference to the Government Policy, as under:
“Heard Sri Vijay Bahadur Singh, learned Advocate General assisted by Smt. Sangeeta Chandra, learned Chief Standing Counsel-III for the appellant and learned counsel for the respondents.
An affidavit of Sri Shree Nath Ram, Deputy Secretary, Law, Government of Uttar Pradesh, Lucknow has been filed in First Appeal No. 29 of 2014. In para 3 and 4 of the aforesaid affidavit it has been stated as under: "3. That, after due deliberation the Government has issued a notification amending the State Litigating Policy, paragraphs 4.6 thereof with respect to filing/ contesting of appeals in matters of small valuation relating to Land Acquisition on 13.10.2016. A true copy of the Notification issued on 13.10.2016 is being filed herewith and marked as Annexure No. 1 to this affidavit.
4. That, it is in the interest of justice that the instant affidavit be taken on record, and this Hon'ble Court may be pleased to pass such other and further order which may deem just and proper in the facts of the case."

¼jaxukFk ik.Ms;½ izeq[k lfpo Valuation of this appeal is Rs. 9587/-.
In view of the decision taken by the State Government as afore quoted, this appeal is dismissed for reasons that valuation of the appeal is below the monetary limit fixed by the State Government. However, dismissal of this appeal shall not come in the way of the State Government to contest appeal of higher valuation as provided in the afore quoted Government Order. Liberty is also granted to the State Government to file a recall application for recall of this order of dismissal of appeal on the ground of smallness of valuation, in case any technical objection is raised by other claimants for dismissal of some other appeal of higher valuation filed by the State Government and arising from the same acquisition.”
In view of the aforesaid, the delay condonation application is rejected. The appeal is dismissed on the ground of delay as well as on the ground of it being below the minimum monetary limit fixed by the State Government in land acquisition matters and the aforequoted judgment of this Court in Agra Development Authority (supra).
