JUDGMENT / ORDER

IN THE HIGH COURT OF JUDICATURE AT HYDERABAD FOR THE STATE OF TELANGANA & THE STATE OF ANDHRA PRADESH (Special Original Jurisdiction) FRIDAY, THE FIFTH DAY OF SEPTEMBER TWO THOUSAND AND FOURTEEN PRESENT THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No. 24996 of 2014 BETWEEN Surender Joshi AND ... PETITIONER State of Telangana, rep. by its Principal Secretary and others ...RESPONDENTS The Court made the following:
ORDER:
Though the learned government pleader was granted time to get instructions, no instructions are received. He again seeks further time. Keeping in view the relief sought for, the grant of any further time would not be in the interest of justice. Hence, the request for adjournment is rejected.
2. Petitioner’s limited grievance in this writ petition is that aggrieved by the orders passed by the Tahsildar, Bibinagar, in proceedings No.B/6390/2011, dated 18.10.2012, petitioner preferred an appeal before the Revenue Divisional Officer, respondent No.2, under Section 5 of the A.P. Rights in Land and Pattadar Passbooks Act, 1971. Said appeal appears to have been acknowledged by the office of respondent No.2 on 19.11.2012, as is evident from the inward stamp on the copy of the appeal, and the same is numbered as Appeal No.D/3880 of 2012. The grievance of the petitioner is that though the appeal is pending since then, not even a single date of hearing is notified and thereby, the appeal is not taken up even after lapse of almost two years.
3. In the circumstances, therefore, the writ petition is disposed of directing respondent No.2 to fix a date for hearing of the appeal, after giving notice to the parties and decide the said appeal expeditiously, in any case, within three months from the date of receipt of a copy of this order.
As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
