IN THE HIGH COURT OF JUDICATURE AT HYDERABAD FOR THE STATE OF TELANGANA & THE STATE OF ANDHRA PRADESH (Special Original Jurisdiction) FRIDAY, THE FOURTEENTH DAY OF NOVEMBER TWO THOUSAND AND FOURTEEN PRESENT THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR BETWEEN S.Mutyalu AND WRIT PETITION No.33829 of 2014 ... PETITIONER The State of Telangana, Rep. by its Principal Secretary (Department of Revenue), A.P. Secretariat Building, Hyderabad and others.
...RESPONDENTS The Court made the following:
ORDER:
Heard.
2. Petitioner filed this writ petition alleging that in spite of filing complaint of illegal interference before the Sub-Inspector of Police, respondent No.4, as early as on 07.10.2014, no action is being taken by the police. Petitioner places strong reliance on Ex.P1-copy of the complaint, which is stated to have been endorsed by the Tahsildar’s office to respondent No.4.
3. Learned Government Pleader has received instructions, which inter alia state that respondent No.4 has not received any complaint from the petitioner and that there appears to be a civil dispute.
4. However, since there is no complaint received by respondent No.4 from the petitioner and the petitioner being unable to show any acknowledgment of his complaint having been filed before respondent No.4, I am not inclined to entertain the writ petition.
Writ petition is, therefore, disposed of permitting the petitioner to file a complaint before respondent No.4, if he so desires, and if the said complaint discloses any cognizable offence, respondent No.4 shall take appropriate action in accordance with law. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
