This appeal is filed by the State aggrieved by the judgment in L.A.R.No.478/2008 on the file of the Second Additional Sub Court, Thiruvananthapuram. The land was acquired for the purpose of widening road from Karamana to Killippalam Reach No.III. The section 4(1) notification was published on 7.6.1999 and the land acquisition officer awarded land value @ `1,64,673/- per Are. The same was enhanced by the court below to `9,88,000/- per Are by relying upon the judgment in L.A.R.No.125/2007 produced as Ext.A1.
2. The learned Government Pleader points out that the relied on judgment in L.A.R.No.125/2007 was subjected to appeal before this Court in L.A.A.No.132/2011. The said appeal was allowed refixing the land value at ` 6,10,000/- per Are by judgment dated 20.6.2011.
3. We heard the learned counsel for the claimant and the learned Standing Counsel for the requisitioning authority also.
4. In the light of the judgment in L.A.A.No.132/2011, the land value awarded herein requires modification. Accordingly, we refix the land value of the property acquired herein at `6,10,000/- per Are. The judgment of the reference court is modified accordingly. The claimants will be entitled for all other statutory benefits as granted by the trial court. The amount covered by the judgment and decree will be deposited expeditiously.
The appeal is allowed as above. No costs.
