JUDGMENT / ORDER

Petitioners are accused 2 to 10 in Crime No.3 of 2014 of Thekkumbhagom Police Station registered under Sections 143, 147, 148, 324, 326 and 506(ii) read with Section 149 of the Indian Penal Code. Prosecution case is that on 01.01.2014 at about 1.30 hours in the night a dispute arose between the defacto complainant and the accused resulting in sustaining injury by the defacto complainant.
2. Heard the learned counsel for the petitioners and the learned Public Prosecutor.
3. Learned counsel for the petitioners submitted that they are prepared to surrender before the Judicial First Class Magistrate Court-I, Sasathamcotta and move for regular bail. Petitioners' only request is that the bail application should be directed to be considered on the date of their surrender itself. Considering the entire facts and circumstances, I find that the request made by the petitioners is proper.
In the result, the petition is allowed. In the event of the petitioners surrendering before the learned Magistrate and moving for bail, Crl.MC No.2632/2014 2 the learned Magistrate shall consider the bail application on merits on the date of their surrender itself.
