JUDGMENT / ORDER

Petitioners are accused 1 and 3 in C.C.No.954 of 2010 on the file of the Judicial First Class Magistrate Court, Tirur. They are involved in Crime No.973 of 2009 of Tirur Police Station registered under Section 509 read with Section 34 of the Indian Penal Code.
2. Heard the learned counsel for the petitioners and the learned Public Prosecutor.
3. Learned counsel for the petitioners submitted that they could not appear before the court for reasons beyond their control and now warrants are pending against them. They are prepared to surrender before the trial court and move for bail. Their only request is that the bail applications should be considered by the learned Magistrate on the date of their surrender itself. Considering the entire facts and circumstances, I find that the request made by the petitioners can be granted.
In the result, the petition is allowed. In the event the petitioners surrender before the trial court and move for bail, the learned Magistrate shall consider the bail application on merits on the date of their surrender itself and pass appropriate orders thereon. Petitioners are Crl.MC No.2670/2014 2 directed to surrender before the learned Magistrate within a period of ten days from today. Till then the warrants pending against the petitioners will be kept in abeyance. It is made clear that if they do not surrender as directed in the stipulated time, the court is free to proceed with the matter in accordance with law.
All pending interlocutory applications will stand dismissed.
