This Court vide order dated 26/2/2014 dismissed the petition for condonation of delay in filing the appeal. The petition was filed to condone the inordinate delay of 1211 days in filing the appeal. The reason stated for the delay was considered by this Court. This Court finds that there was no explanation or no satisfactory reasons are stated for not applying for the copy of the decree and judgment within a reasonable time. There was a delay of 2 years, 8 months and 1 day for applying for copy of the judgment and decree. Again this Court find that there was no explanation for not filing the appeal within a reasonable time thereafter also. Though the office of the Advocate General received file on 13/3/2012, the appeal was filed only on 5/11/2012 i.e. after a period of 8 months. This Court find that there was no explanation even offered for not preferring the appeal within a reasonable time after obtaining the files from the office of the District Collector. This Court dismissed the application for condonation of delay finding that there is gross laches and wilful negligence on the part of the petitioner/appellant in causing the delay of 1211 days.
2. Review Petition is filed seeking to review the order on the R.P.No.419/2014 -2-
ground that similar appeals under the same notification were allowed, the award of the reference court was set aside and the reference court passed revised award. The said grounds urged in the review petition is not at all a ground for reviewing the order passed, after considering the matter on merits. Simply because, other similar matters are pending, disposed or remanded is not a ground for reviewing the order impugned.
Review Petition lacks merit and accordingly dismissed.
