JUDGMENT / ORDER

Petitioners herein are the four accused in C.C. No. 888/2014 of the Judicial First Class Magistrate Court, Sasthamcottah. Crime in the said case was registered under Sections 143, 147, 148, 324, 427 and 149 IPC, on the complaint of one George Gomes, who is the 2nd respondent in this proceeding. The accused seeks orders quashing the prosecution under Section 482 Cr.P.C., on the ground that they and the defacto complainant have settled the whole dispute amicably out of court. 2. 2nd respondent has filed affidavit to the effect that he has settled the whole dispute with the accused, and that he has no grievance or complaint now. The parties seek orders under Section 482 because non-compoundable offences are involved in this case, and composition as such is not possible. I find that continuance of prosecution will not serve any purpose, when the parties have amicably settled the whole dispute out of court.
Crl.M.C.. No. 5795/2014 2 In the result, this Crl.M.C. is allowed. The prosecution as against the accused in C.C. No. 888/2014 of the Judicial First Class Magistrate Court, Sasthamcottah will stand quashed under Section 482, and the petitioners will stand released from prosecution. Bail bond, if any, executed by the petitioners will stand discharged.
