The petitioner was given No Objection Certificate by the Local Authority for constructing residential building. The petitioner wants to extract the ordinary earth from the site covered by the No Objection Certificate. In view of the Government Order produced as Exhibit P2, no permit is required for extracting ordinary earth from the site covered by the permission given by the Local Authority to construct a residential building. However, for the purpose of transporting the ordinary earth from the site the petitioner requires ‘P Form’. 2. In view of the above, there shall be a direction to the 3rd respondent to issue necessary ‘P-Form’ to the petitioner on being satisfied with the genuineness of the claim raised by the petitioner without insisting No objection Certificate. This shall be done within a period of ten days from the date of receipt of a copy of this judgment.
The writ petition is disposed as above.
