The appeal is filed by the respondent in Writ Petition No.34110 of 2008, claiming to be aggrieved by the judgment dated 4.1.2012 whereby the learned Single Judge set aside Ext.P4 and directed the appellants to refix the pay of the petitioner consequent on his promotion with effect from 2.9.2002.
2. When the appeal was taken up, the main grievance that was highlighted by the learned Government Pleader was that the directions in the judgment would fasten the Government with liability for monetary benefits to the respondents consequent on the retrospective promotion.
3. However, on the basis of the instructions obtained by him, the learned counsel appearing for the respondent submitted before this Court that the benefits due under the judgment have already been received by him.

If that be the factual situation, we do not want to upset the status quo that is prevailing. Therefore, taking note of the submission made by the counsel for the respondent, this appeal is closed.
