JUDGMENT / ORDER

Petition filed under Section 439 Cr.P.C.
2. Petitioners are A1 and A4 in Crime No.433/2012 of Bekal Police Station, Kasaragod registered for the offences punishable under Sections 143, 147, 148, 341, 326 and 307 read with Section 149 of the Indian Penal Code.
3. Heard learned counsel for the petitioners and the learned Public Prosecutor.
4. In view of order dated 03.09.2012 in B.A.5999/2012 and order dated 03.10.2012 in B.A.7147/2012, I am of the view that bail can be granted to the petitioners.
5. In the result, this Bail Application is allowed and the petitioners are enlarged on bail subject to the following conditions:
1) The petitioners are directed to be enlarged on bail on each of them executing a bond for ₹15,000/-(Rupees Fifteen thousand only) each with two solvent sureties each, for the like sum each, to the satisfaction of the Judicial First Class Magistrate-II, Hosdurg.
2) The petitioners shall report before the investigating officer twice a week, on every Friday and Tuesday between 10 a.m. and 12 noon, commencing from 31.10.2014, for a period of six weeks and thereafter, once in a week on every Tuesday at the time fixed above for another three months or till the completion of the investigation which ever is earlier.
3) The petitioners shall not intimidate, terrorize or influence any of the witnesses connected with the crime nor make any attempt to obliterate the evidence in the crime.
4) The petitioners shall surrender their passports before the Magistrate and if not in possession of such a document, then, file an affidavit, affirming so.
5) The petitioners shall not leave the jurisdiction of Kasaragod district without getting prior permission from the court for a period of three months from the date of their enlargement on bail.
