JUDGMENT / ORDER

Petition filed under Section 439 Cr.P.C.
2. Petitioners are accused Nos.3 and 2 respectively, in Crime No.1652/2014 of Kalamassery Police Station registered for the offences punishable under Sections 406, 420 and 120(B) read with Section 34 of the Indian Penal Code.
3. The allegations against the petitioners and other accused, is that they, by offering an employment abroad in U.K., obtained the bio-data, copies of certificates and copy of passport and an amount of ₹1,40,000/- from the de-facto complainant. They have defrauded and cheated the de-facto complainant and did not care to arrange any visa, as offered.
The petitioners have been in custody for the period from 26.10.2014 onwards.
4. Heard the learned counsel for the petitioners and the learned Public Prosecutor. Even though the learned counsel for the petitioners have argued that the petitioners had nothing to do with the incident involved in this case, and they were only the employees of the first accused, it has come out that the amounts had reached the Bank account of the second accused/ second petitioner herein. It has come out that the petitioners and the first accused are hand in gloves in the incident, and they are involved in a series of crimes, wherein lakhs of rupees were obtained from several other job seekers. The investigation of this case is only in its infancy. The contents of the C.D. Prima facie reveal the complicity of the petitioners. Considering the seriousness of the allegations against the petitioners, the present stage of investigation and the involvement of the petitioners in a series of cases, I am satisfied that the petitioners are not entitled to be enlarged on bail.
In the result, this bail application is dismissed.
