Ramachandran Nair, J. These appeals arise from the judgments of the reference court in various cases. The acquisition was for the purpose of Pattom - Medical College - Kochulloor road. The notification under Section 4(1) of the Act was issued on 24.12.2004. The Land Acquisition Officer awarded land value at Rs.2,39,248/- which has been enhanced by the reference court at Rs.22 lakhs per are, relying upon various judgments. Ext.A1 in some of the cases is the common judgment in L.A.R. No.26/2008 and connected cases.
The reference court relied upon a judgment of this Court in LAA No.1063/2010. Ext.A3 produced in some of the cases is the judgment in L.A.A.No.1204/2010.
2. Learned counsel for the respondents submitted that with regard to the same acquisition, this Court in L.A.A.No.232/2012, which is an appeal filed by a claimant, this Court fixed the land value at Rs.24,17,100/- per LAA No.813/2012 & connected cases -2-
are.
3. We have gone through the above judgment. The acquisition is for the same purpose and the land value awarded by the Land Acquisition Officer is at Rs.2,39,248/- per are. The reference court enhanced the same by fixing land value at Rs.22 Lakhs per are. After referring various aspects this Court allowed the appeal and fixed the market value of the land at Rs.24,17,100/- per are..
4. In that view of the matter also and, as the reference court fixed market value only at the rate of Rs.22 Lakhs per are in these cases, we will be justified in relying upon the judgment in L.A.R. No.232/2012 and therefore no interference is called for in respect of the judgments impugned. The appeals are therefore dismissed. No costs.
