Ramachandran Nair, J. Both these appeals are filed by the State, aggrieved by the judgments in L.A.R.Nos.593/2009 and 830/2008, respectively.
2. The acquisition is for the purpose of widening of Pattoor - Choorakattupalayam road in Thycaud Village in Thiruvananthapuram Taluk. The notification under Section 4(1) of the Act was published on 20.5.2005 and 31.3.2005 respectively and the awards were passed on 22.9.2007 and 19.5.2007 respectively. The Land Acquisition Officer awarded land value at Rs.3,70,500/- per are and the reference court refixed the same at Rs.20,00,700/-.
3. The reference court relied upon Ext.A1 judgment in LAA No.241/2005 in LAR No.593/2009 and the judgment in LAR No.489/2008 was relied on L.A.R. No.830/2008.
4. It is brought to our notice that in L.A.A. No.284/2012 which was a case concerning the very same acquisition, this Court has fixed the land LAA Nos.172 & 232/2013 -2-
value at Rs.23 Lakhs per are. We have gone through the judgment. It is seen that the notification under Section 4(1) of the Act was published on 19.5.2006 and the Land Acquisition Officer awarded land value at Rs.3,70,500/- per are. After considering various aspects, this Court fixed the land value at Rs.23 Lakhs per are.
We, therefore, rely upon the above judgment for fixing the land value as far as these cases are concerned. Since the reference court has fixed the land value at Rs.20,00,700/- per are, we confirm the same and the appeals are accordingly dismissed. No costs.
