JUDGMENT / ORDER

Petitioners claim that they were casual labourers engaged by the Irrigation Department in connection with the works being done at Malampuzha Dam. List had been prepared by the concerned authority. Complaint is that overlooking the said list, certain other casual workers are being engaged. Petitioners claim that they are working as casual labourers for a quite long time and normally the work was being given based on the said list. Without any further notice, outsiders are being engaged for the work which is affecting their livelihood. Petitioners submitted Ext.P2 to P10 representations to the 2nd respondent and without even caring to consider such representations, the respondents are proceeding to engage outside labourers. 2. Having regard to the fact that the petitioners have been working as casual labourers in the said establishment for a quite long time, before employing persons from outside it is always incumbent on the respondent authority to consider at least the claim put forward by the petitioners. They do not claim any permanency in the employment, but they only claim that they should be employed on casual basis.
3. Under such circumstances, there will be a direction to the 2nd respondent to consider Exts.P2 to P10 representations and to pass appropriate orders thereon within a period of one month from the date of receipt of a copy of this judgment. In that process, the petitioners also be given an opportunity of being heard.
The writ petition is disposed of as above.
