Vishwamurthy, HCGP) This Criminal Petition is filed under Section 438 of Cr.P.C. praying to enlarge the petitioner on bail in the event of their arrest in crime No.201/2017 of Chitradurga Police Station, Chitradurga District for the offence p/u/s 420, 406 r/w 34 of IPC.
This Criminal Petition is coming on for orders this day, the Court made the following:
ORDER Heard the learned counsel for the petitionersand the learned HCGP for the respondent.
2. Petitioners apprehend their arrest by the respondent police in their crime No. 201/2017 registered in respect of the offence punishable under Sections 420 and 406 read with 34 of IPC.
3. The allegation is the complainant was engaged to the first petitioner and the marriage was scheduled to be celebrated on 28th and 29th of May, 2017. But the 1st petitioner married the second petitioner by cheating her. The complainant and his family had spent about Rs.2,00,000/- towards the marriage arrangements etc.
4. Having regard to the nature of the allegation, there is no impediment to allow the petition.
Petition is allowed. Petitioners are granted anticipatory bail in their crime No. 201/2017 registered by the respondent police. In the event of their arrest by the respondent police, in respect of the above case, they shall be released on bail on each of them executing a self bond for a sum of Rs.50,000/- with one surety to the likesum.
