Vishwamurthy, HCGP) This Criminal Petition is filed under Section 439 of Cr.P.C praying to enlarge the petitioner on bail in Cr.No.135/2017 of Tumakuru Rural Police Station, Tumakuru for the offence P/U/S 307 r/w 34 of IPC.
This criminal petition coming on for Orders, this day, the Court made the following:-
ORDER The petitioner is charge sheeted by the respondent-Police in Crime No.135/2017 for the offence punishable under Section 307 read with Section 34 of IPC.
2. The allegation is, by assuming illicit relationship between complainant’s son and wife of the petitioner No.1/accused No.1, accused No.2 caught hold of victim Anjanappa and petitioner stabbed at Anajanappa’s neck with a knife. The victim is said to have been hospitalized for a period of four days, thereafter, he was discharged. The investigation is completed. Having regard to the nature of the allegation, there is no impediment to allow this petition.
Petition is allowed. Petitioner is enlarged on bail in Cr.No.135/2017 registered by respondent-Police subject to the following conditions;
i) He shall be released on bail after executing a self bond for a sum of Rs.1,00,000/- with one surety for the likesum to the satisfaction of the concerned Court;
ii) He shall attend the Court regularly on all the dates of hearing;
iii) He shall not threaten or prevail upon the prosecution witnesses, or his son Anajanappa or family members;
iv) He shall maintain himself as law abiding citizen;
v) He shall not do any harm to his wife Smt.Madhumati and family members;
