Narthana G U, Advocate for R2) This Criminal Petition is filed under Section 482 of Cr.P.C., praying to quash the proceedings in C.C.No.4060/2019 vide document No.3, on the file of the VI ACMM at Bengaluru for the offence punishable under Section 498A, 506 read with Section 34 of IPC.
This Criminal Petition coming on for orders this day, the Court made the following:
ORDER The first petitioner and the second respondent/complainant are present.
2. It is submitted by the learned counsel for the parties that the first petitioner and the second respondent have now re-united and hence, the parties may be permitted bury their disagreements that have occurred in the past.
3. On a query, the second respondent would affirm the same. In that view of the matter, this Court is of the considered opinion that in the light of the parties having entered into an amicable settlement and having resolved their matrimonial disputes, the first petitioner and the second respondent are permitted to unite and lead a life of tranquility and peace.
4. Hence, the affidavits filed before the Court by the first petitioner and the second respondent are taken on record.
5. In the light of the law laid down by the Apex Court in the case of GIAN SINGH VS STATE OF PUNJAB & ANR, the petition requires to be allowed. Consequently, proceedings in C.C.No.4060/2019 on the file of the VI Additional Chief Metropolitan Magistrate, Bengaluru City stands quashed.
Ordered accordingly.
