JUDGMENT / ORDER

State of Karnataka, By Puttur Rural Police, Puttur – 574201. ... Respondent (By Sri. S. Vishwamurthy, HCGP) This Criminal Petition is filed u/s.439 Cr.P.C praying to enlarge the petitioner on bail in Cr.No.32/2017 of Puttur Rural Police Station, D.K., for the offence P/U/S 399 and 402 of IPC.
This criminal petition coming on for Orders this day, the Court passed the following:
O R D E R Heard the learned counsel for the petitioner and the learned High Court Government Pleader for the respondent.
2. The respondent-Police registered a case in Crime No.32/2017 against the petitioner (Accused No.1) and 6 others in respect of offences punishable under Sections 399 and 402 of IPC.
3. The allegation is that the accused persons had made preparation with a Xylo and Ritz Cars to transport stray live stocks on the road and on seeing police personnel they all disappeared. However, the petitioner was apprehended. Investigation revealed that the accused were also contemplating to commit dacoity of the tourist vehicle passing on the road, etc.
4. The petitioner is in custody since 02.03.2017. The nature of the allegations does not call for his continued custody for the purpose of further investigation. In the given circumstances there is no impediment to allow the petition. Accordingly, I pass the following:
This petition is allowed. Petitioner is enlarged on bail in Crime No.32/2017 registered by the respondent police on executing a self-bond for Rs.50,000/- (Rupees fifty thousand only) with one local surety for the likesum to the satisfaction of the trial Court. He shall appear before the respondent Investigation Officer whenever called for, for the purpose of investigation.
