Mohammed Azeez, Aged about 82 years, All are residents of No.45, 17th Cross, Vivani Road Cross, Sagayapura, Near Firdos Maszid, Bangalore North Frazer Town, Bangalore – 560 005. ….Respondents (By Shri. Mohan Kumar D, Advocate for Shri. C.S.Pradeep, Advocate) This Criminal Petition is filed under Section 439(2) Cr.P.C., praying to cancel the bail order dated 05/05/2018 granted by the 57th Additional City Civil and Sessions Judge, Mayo Hall Unit, Bengaluru (CCH-58), Bengaluru, enlarging the accused –respondents on bail in Criminal Misc.Petition No.25400/2018, in connection with the Crime No.183/2017 of K.G.Halli Police Station for the offences punishable under Sections.143, 147, 341, 323, 324, 504, 506 r/w 149 of IPC and direct the accused be arrested and committed to custody.
This petition coming on for orders this day, the Court made the following;
ORDER This petition is filed seeking cancellation of anticipatory bail order dated 05/05/2018 passed by the 57th Additional City Civil and Sessions Judge, Mayo Hall Unit, Bengaluru in C. Misc. No.25400/2018.
2. Learned counsel for the respondent files memo with copy of the bail orders dated 28/05/2018 and 30/05/2018 in Crime No.183/2016 passed by the XI A.C.M.M., Bengaluru.
3. The said orders show that after passing of the impugned anticipatory bail order, the Magistrate has granted regular bail to accused Nos.1 to 5. Therefore, this petition does not survive for further consideration and disposed of accordingly.
