By way of this appeal, the appellants – original petitioners have challenged the judgment and order dated 13.4.2010 passed by the Learned Single Judge in Special Civil Application No.3414 of 2010 by which the petition was dismissed on several grounds including the ground of delay and laches in preferring the writ petition as well as on the ground that possession of the disputed land was taken by the authority after following the due procedure on 31.8.1987 in presence of two Panchas and the Panchnama is produced at page 157 of the writ petition. 2. In view of the factual aspect, we are in agreement with the observations made by the learned Single Judge in the impugned judgment and order. No interference is called for in the impugned judgment of the learned Single Judge. The appeal is devoid of any merits and deserves to be dismissed. Hence, the appeal is dismissed. Notice discharged. The parties to bear their own costs.
3. In view of dismissal of the main appeal, Civil application also stands dismissed.
