1. Heard Mr. Pradeep Patel Learned advocate for the petitioners and Ms. Jyoti Mehta Learned Assistant Government Pleader for the respondents.
2. Three petitioners had approached this Court with the principal grievance that they are not being promoted on the post of clerk. It is indicated that during pendency of the petition, petitioner no.1 has died and legal heirs have come on record. So far as petitioners no.2 and 3 are concerned, their grievance has stood redressed since they are promoted on the post of clerk, of course belated. Learned advocate for the petitioner states that in view of this, the principal grievance would not survive and he does not press this petition further.
3. It is indicated that the petitioners ought to have been promoted much earlier and for that the petitioners will make representations to respondent no:2 and he may take into consideration the representation as to on which date, the promotion should be deemed to have been given. It is clarified that the said issue is not gone into by this court and is kept open.
4. Petition stands disposed of with the above observations.
Rule is made absolute to the above extent. No costs.
