This Court ( Coram:K.J.Vaidya & D.G.Karia,JJ) by an order dated 10-9-96 issued notice and made it returnable on 25-9-96. Today, the endorsement in the board shows that the notice has not returned either served or unserved. Under the circumstances the office is directed to immediately call for the explanation of the concerned officers as well as the process serving agency on affidavit stating therein as to why and under what circumstances the notice issued by this Court earlier has not returned either served or unserved.
Under the circumstances, the office is directed to issue a fresh notice to the respondent making it returnable on 9th October, 1996. S.O. to 9-10-1996.
