1. The present Criminal Appeal is placed on board for orders on the note filed by Shri Bhargav Bhatt, learned advocate, who appeared on behalf of the original informant permitting him to withdraw his appearance. It appears that Shri Bhargav Bhatt, learned advocate has already informed the original informant intimating his inability to appear in the subject appeal on the ground of want of instructions and the said communication has been served to the original informant by R.P.AD.
2. Under the circumstances, Shri Bhargav Bhatt, learned Page 1 of 2 HC-NIC Page 1 of 2 Created On Fri Aug 28 01:38:12 IST 2015 R/CR.A/101/1995 ORDER advocate is permitted to withdraw his appearance from the appeal as the learned advocate appearing on behalf of the original informant. Registry is directed not to show the name of Shri Bhargav Bhatt, learned advocate, in the appeal.
3. Now the appeal is ready. Registry is directed to issue fresh notice upon the respondent-Bhupatbhai Dayashankar Bhatt residing at Village Umrala, District Bhavnagar-original informant making it returnable on 26/12/2012 informing him to make an alternative arrangement, if he so chooses.
