1. We have heard Mr.Rakesh Patel, learned Assistant Government Pleader appearing for the appellants and Mr.Majoj Shrimali, learned counsel appearing for the respondent. Learned counsel for the parties agree that the controversy involved in this Letters Patent Appeal is covered by the Division Bench decision of this Court in LPA No.1110 of 2012 in State of Gujarat vs. Gitaben M.Parmar decided on 4.9.2012. Therefore, this LPA is disposed of by the following order. Since the impugned order dated 8.2.2012 of the learned Single Judge of this Court is made in an application in the pending Special Civil Application No.197 of 2010 and it is an interim order granting minimum wages on the basis of a Division Bench decision of this Court, the Appeal is not entertained and dismissed without prejudice to the rights and contentions of the appellant in the main petition. The Civil Application does not survive and stand dismissed.
