(PER : HONOURABLE MR.JUSTICE R.P.DHOLARIA) [1] Present application under Section 378(1)(3) of the Code of Criminal Procedure has been preferred by the applicant - State for leave to appeal against the impugned judgment and order dated 27.12.2012 rendered by learned Additional Sessions Judge, Dahod in Sessions Case No.158 of 2011. The accused was charged with offences punishable under sections 302, 504 and 506(2) of the Indian Penal Code. In the said case, the accused was acquitted for all the charges levelled against him.

[3] Having perused the impugned judgment and order of acquittal and considered the submissions made before us, we are of the view that the appeal deserves consideration. Hence, the present application is allowed. Leave to Appeal as prayed for is hereby granted.
