SHAH) Present application under Section 378(1)(3) of the Code of Criminal Procedure has been preferred by the applicant State of Gujarat for Leave to Appeal against the impugned Judgment and Order dated 22.11.2012 passed by the learned Additional Sessions Judge, Amreli in Sessions Case No.56 of 2011 acquitting the respondent herein original accused for the offence under Section 302 of Indian Penal Code.
Having heard Ms. C.M.Shah, learned APP appearing on behalf of the State and having perused the impugned Judgment and Order of acquittal and considering the same, it appears that the appeal deserves consideration. Hence, the present application is allowed. Leave to Appeal as prayed for is hereby granted. Present application stands disposed of accordingly.
