JUDGMENT / ORDER

(PER : HONOURABLE MR.JUSTICE M.R. SHAH) Present application under Section 378 (1)(3) of the Code of Criminal Procedure has been preferred by applicant -State of Gujarat for leave to appeal against the impugned judgment and order of acquittal dated 22.9.2012 passed by the learned Additional City Sessions Judge, Court No.9, Ahmedabad passed in Sessions Case No. 141 of 2010 acquitting the respondents herein-original accused for the offences under Sections 376, 506(2) and 114 of the Indian Penal Code.
Having heard Ms. Shah, learned advocate for the applicant -State of Gujarat and Shri Champavat, learned advocate for Shri R.J. Goswami, learned advocate for the respondents and considering the impugned judgment and order of acquittal passed by the learned trial Court, we are of the opinion that the appeal deserves consideration. Hence, leave to appeal as prayed for is hereby granted. Hence, present application stands disposed of.
