1. Heard learned Additional Public Prosecutor Mr. K. L. Pandya for the applicant and learned advocate Mr. Manish J. Patel for the respondents.
2. Present application under section 5 of the Limitation Act has been preferred by the applicant for condonation of delay caused in filing the criminal appeal challenging the judgment and order dated 03/11/2012, passed by the learned Additional Sessions Judge, Court No. 6, City Sessions Court, Ahmedabad, in Sessions Case No. 494 of 2009.
3. The delay of 90 days, caused in filing the Appeal, has been sufficiently and satisfactorily explained in the application, more particularly in Para 3 and 4 of the same. Hence, this application is allowed and the delay caused in filing the appeal is condoned. Rule is made absolute accordingly.
