(PER : HONOURABLE MR.JUSTICE RAVI R.TRIPATHI) On 03.12.12 the matter was kept today to enable learned APP Ms.Jirga Jhaveri to apprise the Court about the present status of accused no.1.
2. Learned APP makes available Jail remarks. As on 03.12.2012 the convict has undergone 3 years, 5 months and 15 days. The learned APP has submitted that it is possible that during the pendency of this appeal as well as during the pendency of the appeal challenging the conviction opponent no.1 may serve out the sentence and get released. In that event to secure his presence the Court may order that at the time of release of opponent no.1 from Jail on serving out the sentence, bailable warrant Page 1 of 2 R/CR.A/414/2012 ORDER may be got executed by opponent no.1.
Opponent no.1 shall be served with bailable warrant in the event he is going to be released after serving out the sentence in a sum of Rs.5000/- (Rupees five thousand only) So far as opponent no.2, bailable warrant in a sum of Rs.5000/- (Rupees five thousand only).
A copy of this order be kept in the history ticket of the convict. A copy of this order be given to the learned APP for its onward communication.
