(Per : HONOURABLE MR.JUSTICE P.B.MAJMUDAR) This Civil Application is filed by the State for vacating the interim-relief granted by this Court while admitting the Letters Patent Appeal by order dated 14.02.2008. The Division Bench by an order dated 14.09.2007, stayed the order of the learned Single Judge. On the basis of the report of the Dy. Collector dated 17.03.2011, by which, it is found that in the CA/3526/2012 2/2 ORDER Government land 80 ponds have been constructed. It is argued by learned AGP that in view of the said fact, interim-relief granted earlier is now required to be vacated.
Learned counsel for the opponent, Mr. Amit V. Thakkar, requested for some time in order to argue this matter by learned senior counsel Mr. Sanjanwala who is not available today. We accept the request and adjourned this matter to 27th August, 2012. However, we direct the opponent herein to maintain status-quo prevailing as on today and not to carry out any activity in the nature of fishing and will not commit breach of the status-quo in any manner. If any reply is to be filed, the same may be filed latest by 25th August, 2012.
