DAVE Date : 27/02/2012 ORAL ORDER Learned counsel for the petitioners has placed reliance on the order dated 14.2.2012 passed by a Division Bench of this court in Special Criminal Application No.256 of 2012 in the proceeding of habeas corpus in nature where Ashaben Desai, aged 24 years, clearly and categorically stated that she wanted to live with petitioner No.1, who was also the petitioner in the habeas corpus petition, as she is legally wedded wife.
In view of the above, issue notice returnable on 21.3.2012. Adinterim relief in terms of paragraph 8(C). Learned APP waives service on behalf of the State. Respondent No.2 be served through the police officer in charge of the police station of the area where he resides.
